$750,000 Settlement Reached for Family of Tractor-Trailer Accident Victim
After a tractor-trailer struck a 79-year-old woman on her bicycle, who eventually succumbed to her injuries, SPBMCC Associate R. Thomas Colonna obtained a settlement totaling $750,000 on behalf of the victim’s family.
79-Year-Old Bicyclist Struck by Tractor Trailer Sustains Fatal Injuries
In 2019, an elderly woman was struck by a tractor-trailer in an intersection while riding her bicycle in Jersey City. Both were waiting at an intersection for the traffic light to turn green. When it changed, the truck made a right turn and struck the victim in a crosswalk.
The victim, who was found under the left front tire of the tractor, was unresponsive when EMTs arrived at the scene. She suffered sternum and rib fractures, a right femur fracture, and the amputation of her left leg—but no head injury—after being dragged for up to three seconds by the vehicle.

After this tragic death, her estate sought representation from SPBMCC to sue both the driver and the company for which he worked. Firm associate R. Thomas Colonna provided legal counsel for the family and argued that, despite surviving only a brief period, the victim had no evidence of a head injury and therefore must have suffered excruciating pain until she passed out from loss of blood. Armed with that argument, Colonna was able to secure a settlement for $750,000 for no more than 60 seconds of pain and suffering. Wrongful death damages were not available because the victim was survived only by two sisters whom she did not support.
As a result of this settlement, the company has now installed cameras in their vehicles.
