Sullivan Papain Attorney Eric Schwarz Secures $905,000 Settlement for Injured Electrician in Labor Law Case

Sullivan Papain is pleased to announce that member Eric Schwarz obtained a $905,000 settlement on June 11, 2025. The settlement was on behalf of a 58-year-old journeyman electrician injured while working on a subway infrastructure project in Brooklyn.

The incident occurred during a project to replace the signal system on an elevated portion of the subway line. While descending a ladder attached to a scissor lift, the worker was caused to fall when he stepped down onto cracked and uneven sidewalk pavement. The unstable surface slid underfoot, leading to a fall that caused his left knee to buckle.

The worker sustained multiple ligament tears in his left knee. He underwent a series of medical procedures, including arthroscopic repair, a total knee replacement, and a manipulation under anesthesia. Despite the treatment, he experienced lasting physical limitations that prevented him from returning to work as an electrician, particularly due to difficulty climbing ladders and stairs.

The case was filed in Supreme Court, Kings County, and was on the trial calendar at the time of resolution. The claim was brought under provisions of New York State Labor Law, which provides protections for construction workers injured due to unsafe worksite conditions.
