Our client (plaintiff), age 57, was operating his motorcycle on a through street at a “T” intersection, in Bernardsville, New Jersey, when the operator of another motor vehicle pulled out past a stop sign, on the cross street and to plaintiff’s right, and attempted to make a left turn in front of our client. In doing so, defendant caused plaintiff’s motorcycle to crash into the right side of defendant’s car. The collision caused Plaintiff to be thrown off the motorcycle, across the intersection and into a wall. As a result, our client suffered multiple injuries, including a below-the-knee amputation of his right leg and a torn rotator cuff in his right shoulder.  The defendant motorist testified that before moving into the intersection, he looked left and right but did not see our client despite the fact that the road was straight and flat for several hundred yards in our client’s direction.

Plaintiff sustained open comminuted fractures of his right leg, which resulted first in the application of an external fixator and then in a guillotine type amputation of the leg below the knee. He went on to suffer numerous complications after that surgery, including osteomyelitis and a delayed union of the fractures of the bones in the remaining stump. He underwent numerous additional surgical procedures, including skin grafts, to address that delayed union and the osteomyelitis. In addition to the leg amputation, our client suffered a severe torn rotator cuff in his right shoulder which also required surgical repair. This injury, together with the other complications, interfered with his ability to go to physical therapy for his leg injury and caused problems with the fit of his prosthetic leg. Since the accident, he has suffered phantom limb pain, depression, anxiety, sleeplessness, and is unable to return to his job as an HVAC foreman in New York City.

We obtained a $4.3 million settlement for our client before trial.
