Sullivan Papain attorney Chris DelliCarpini attended the American Bar Association’s Annual Conference, which brought together members of the legal profession to discuss issues affecting the practice of law, legal education, and the administration of justice.
A highlight of this year’s conference was the ABA House of Delegates meeting, held August 3–4. The House considered reports from ABA leadership, voted on new officers, and addressed dozens of resolutions covering a broad range of issues affecting the legal profession and the rule of law.
Addressing the Practice of Law and Legal Education
Several resolutions considered by the House focused directly on the legal profession and the practice of law. Among them were amendments to the ABA’s rules of professional conduct, as well as a resolution encouraging law schools to examine the effects of increasingly accelerated law firm recruitment timelines.
The resolution concerning recruitment timelines called on law schools to study how early hiring practices may affect the quality of legal education, the well-being of law students, and the long-term health of the entry-level legal hiring market. The issue reflects broader questions facing legal education as law students and law firms navigate an increasingly competitive recruitment process.
Resolutions Supporting the Rule of Law
Other resolutions addressed issues extending beyond the day-to-day practice of law and focused more broadly on the ABA’s commitment to promoting the rule of law and access to justice.
Among the resolutions adopted was one urging governments and schools to ensure that students have access to comprehensive and inclusive suicide prevention and mental health services.
The House also considered a resolution proposed by the New York State Bar Association’s Standing Committee on Gun Violence concerning firearm conversion devices. The resolution urged the prohibition of the manufacture, sale, and possession of devices that increase the rate of fire of a semi-automatic firearm to approximate, match, or exceed that of a machine gun.
Debate Over Diversity, Equity and Inclusion Standards
One of the most closely watched and debated resolutions concerned the ABA’s diversity, equity, and inclusion standard for law school accreditation.
The ABA is the nation’s accrediting organization for law schools, and graduation from an accredited law school is generally a prerequisite for eligibility to sit for a state bar examination. At the same time, the U.S. Department of Education has raised questions regarding the ABA’s continued status as an accrediting agency in connection with its DEI accreditation standard.
The resolution seeking to repeal the ABA’s DEI standard was ultimately defeated. A majority of the House opposed changing the ABA’s position on diversity, while questions also arose concerning the procedural authority of the ABA’s accreditation section to independently repeal the standard.
The vote preserved the ABA’s current commitment to its DEI accreditation standard, while leaving open questions regarding the future of the ABA’s role as the nation’s accreditor of law schools and its relationship with the U.S. Department of Education.
Continuing Engagement in the Legal Profession
The House of Delegates will next convene during the ABA Midyear Conference, scheduled to take place in Chicago from January 27 through February 1, 2027.
