Sullivan Papain Secures $500,000 Settlement for Injured Carpenter in Southern District of New York

Sullivan Papain is proud to announce a $500,000 settlement secured by attorney Joseph Rozovsky on behalf of a 40-year-old carpenter who suffered serious injuries in a preventable workplace fall in the Southern District of New York.

 

At the time of the incident, our client was performing construction work on the ground floor of a multi-story commercial building. His employer had been contracted to extend building columns and install sheetrock. While carrying out his assigned task, he was directed to fasten sheetrock to newly framed sections of the structure.

 

To complete the work, a six-foot ladder was placed on top of plastic floor protection that had not been secured or properly stabilized. The plastic surface created an unsafe and unstable condition. As our client climbed the ladder to reach the work area, it suddenly shifted and slid out from beneath him. He fell approximately four to six feet to the floor below.

 

This incident exposed our client to an elevation-related hazard that should have been addressed with proper safety planning and equipment. Construction site safety regulations require that workers be provided with appropriate protection when performing elevated work. In this case, no adequate safety devices were supplied. A properly secured ladder or scaffold could have prevented the fall entirely.

 

As a result of the accident, our client sustained a serious lateral tibial plateau fracture. The injury required surgical intervention and a significant period of recovery. Through medical treatment and rehabilitation, he made an excellent recovery and was able to return to work approximately four months after the incident.
