Video Game Addiction (“VGA”)
Overview of the Claims
Video Game Addiction (VGA) is recognized by leading medical authorities as a legitimate mental health condition. The World Health Organization classifies it under the International Classification of Diseases (ICD-11) as “Gaming Disorder,” while the American Psychiatric Association identifies it in the Diagnostic and Statistical Manual of Mental Disorders (DSM-5) as “Internet Gaming Disorder.” According to the Cleveland Clinic, VGA is marked by a significant loss of control over gaming behavior, where gaming takes precedence over essential life activities and continues despite negative consequences.

Common symptoms include impaired cognitive function (such as distorted time perception and poor decision-making), emotional instability (including anger, anxiety, and depression), social withdrawal, declining academic or workplace performance, and disinterest in other activities. VGA frequently results in compulsive play, sleep deprivation, and other harmful mental, emotional, and physical consequences.

Claims are being brought against video game publishers and console manufacturers on the grounds that these companies have knowingly and deliberately designed their products to be addictive. The core allegation is that these companies employ behavioral manipulation techniques—including operant conditioning, AI-driven engagement loops, and psychologically exploitative in-game features such as microtransactions—to maximize user screen time and, by extension, company profits.
These features are not incidental; they are deliberately engineered to exploit the psychological vulnerabilities of young users, particularly children and adolescents, with the intent of fostering compulsive use and prolonged engagement.
The litigation targets several major players in the gaming and tech industries, including:
- Microsoft (Minecraft, Candy Crush, Xbox)
- Epic Games (Fortnite)
- Roblox Corporation (Roblox)
- Activision Blizzard (Call of Duty, World of Warcraft)
- Take-Two Interactive (Grand Theft Auto, NBA 2K)
- Electronic Arts (FIFA, Madden NFL)
- Meta Platforms, Inc. (formerly Facebook, Oculus)
- Sony Interactive Entertainment (PlayStation)
- Google (platform for game distribution)
- Apple (App Store distribution of addictive games)
The claims seek damages for a range of mental health and physical injuries linked to VGA, including:
- Mental health injuries: anxiety, depression, sleep deprivation, emotional dysregulation (including anger and rage), social isolation, and—in extreme cases—suicide or suicide attempts.
- Physical injuries: musculoskeletal issues (orthopedic), vision strain and damage (ophthalmic), and other physical consequences stemming from excessive gameplay.
These injuries often manifest in children and adolescents who lack the maturity to self-regulate, making them especially vulnerable to manipulative game design.
