Sullivan Papain Secures $2.25 Million Settlement in Delayed Cancer Diagnosis Case
Sullivan Papain Block McManus Coffinas & Cannavo P.C. is proud to announce a $2,250,000 settlement secured by Associate Ana-Marija Turkovic on behalf of a 50-year-old woman whose stomach cancer diagnosis was significantly delayed due to the negligence of her primary care physician.
For over two years, the plaintiff repeatedly sought medical attention for persistent and worsening gastrointestinal symptoms, including nausea, heartburn, acid reflux, loss of appetite, and anemia. She also had a documented history of Helicobacter pylori infection—a well-known risk factor for stomach cancer. Despite these red flags, the defendant failed to refer the plaintiff to a gastroenterologist for further evaluation and instead continued to prescribe acid reflux medication without further diagnostic workup.
As a result of this failure, the plaintiff’s cancer was not diagnosed until it had progressed to Stage III, with metastasis to her lymph nodes. By the time of diagnosis, her treatment required multiple invasive surgeries and rounds of chemotherapy. According to an expert in surgical oncology retained by the plaintiff’s legal team, an earlier diagnosis would likely have limited her treatment to an endoscopic resection—without the need for chemotherapy or aggressive surgical intervention.
The case settled following the plaintiff’s examination before trial, while still in the discovery phase, in Kings County.
