Sullivan Papain attorney Glenn Nick recently secured a $500,000 settlement for a victim following a trip-and-fall incident on Sutphin Boulevard in Jamaica, Queens.

The accident occurred as our client exited a subway stop onto the public sidewalk when she stepped into a missing section of cement adjacent to a manhole cover. This dangerous and defective condition, which was owned and maintained by Con Edison, caused her to misstep and fall, resulting in significant injuries.

As a result of the fall, our client suffered a full tear of her Achilles tendon, requiring surgical intervention to repair the damage. Her recovery process was long and arduous, involving extensive physical therapy and ongoing medical care. Unfortunately, she has been left with permanent limitations that continue to impact her daily life.

Sullivan Papain pursued a claim against Con Edison in New York State Supreme Court, Queens County, under 34 RCNY § 2-07(b)(1)—a regulation commonly known as “the twelve-inch rule.” This rule mandates that utility companies properly maintain their equipment, including manholes and the surrounding twelve inches of sidewalk, to prevent hazardous conditions.

An inspection confirmed that the hazardous condition had existed for an extended period, meaning Con Edison had ample time to identify and repair the defect. Attorney Glenn Nick was able to demonstrate that the defendant failed in its duty to maintain a safe environment for pedestrians.
