Sullivan Papain’s Glenn Nick Secures $750,000 Settlement on Behalf of Injured Firefighter

In 2020, while performing firefighting operations on the setback roof of a three-story building, the firefighter was struck by falling debris and other objects. The impact caused significant injuries to his neck, ultimately requiring a two-level cervical fusion. Due to the severity of his injuries, the client was forced to retire prematurely from his firefighting career.
An in-depth investigation revealed that the fire originated in a cable junction box located at the rear of the premises. The building’s owner had failed to properly inspect and maintain this equipment, allowing the dangerous condition to develop. The firm pursued claims against the property owner on the basis of general negligence and under General Municipal Law § 205-a, which provides specific legal protections for firefighters injured in the line of duty.
Following the completion of discovery, the case was resolved through private mediation, resulting in a $750,000 settlement.
