Coffinas Recovers $1,200,000 in Breast Cancer Diagnosis Delay Case

Plaintiff Undergoes a Mammogram to Detect Signs of Cancer, Never Receives Results
A 52-year-old woman had a mammogram in February 2016. However, she never received results from her primary care physician who ordered the screening mammogram. She also never received a layperson letter from the radiology facility—a requirement by the radiologist.
In May of 2017, over a year later, the patient returned to her primary care physician for a checkup. At that time, her physician advised her that she needed a follow-up mammogram. This was the first time the physician had recommended a follow-up mammogram and did not provide an explanation as to why he did not tell the patient sooner. After the patient had a follow-up exam, she was diagnosed with Stage 2 breast cancer soon thereafter. As a result, the patient began to undergo chemotherapy, mastectomy, and radiation therapy.
Trial Attorney Eleni Coffinas Claims an Earlier Detection Would Have Prevented a Stage 2 Diagnosis, Obtains Substantial Settlement
Eleni Coffinas, SPBMCC Senior Partner and top trial attorney, represented the plaintiff in the case. Coffinas argued that the plaintiff’s cancer would have been diagnosed at Stage One, not Stage Two, if she had received an earlier diagnosis.
During his deposition, the defendant produced a 35-second phone call between him and the plaintiff several days after the initial mammogram and testified that during that conversation, he told her she needed a follow-up exam. The plaintiff denied that this follow-up conversation ever happened.
Ultimately, on September 1st, 2021 in a Nassau County Court, the prosecution and defense reached a settlement of $1,200,000 to support the plaintiff as she navigates her Stage 2 breast cancer diagnosis and treatment.
