Partner John Nash Obtains Substantial $2,750,000 Settlement for Family of Man Struck in Crosswalk

On November 22nd, 2021, Firm Partner John Nash successfully litigated a case where a man suffered severe injuries after he was struck in a crosswalk by a negligent motor vehicle operator, ultimately resulting in a $2,750,000 settlement for the plaintiff’s family. 

 

 

 

Pedestrian Struck in a Crosswalk In East Hampton, New York Suffers Serious Injuries

 

On Sunday, September 10th, 2010, the plaintiff, a 46-year-old electrician, was struck by a speeding pickup truck as he entered a mid-block crosswalk on Springy Banks Road in East Hampton, New York. 

 

The plaintiff sustained multiple major injuries, the most severe of which was a skull fracture and traumatic brain injury that hospitalized the plaintiff from the day of the crash until the day of his death from unrelated medical issues in 2019.

The victim’s wife, his legal representative, contended that the pickup truck driver acted out of negligence when he sped down Springy Banks Road and crashed into her husband. The plaintiff also alleged that the Town of East Hampton was negligent in the placement of the mid-block crosswalk involved in the crash and that it was not placed nor signed in conformance with the controlling Manual for Uniform Traffic Control Devices.

 

The matter was settled by SPBMCC Partner and seasoned litigator John Nash before a jury selection at a mediation hearing with the retired Honorable Joseph Spinola. The settlement totaling $2,750,000 will help support the plaintiff’s immediate family—his wife and two sons.
