SPBMCC Partner and trial attorney Eleni Coffinas secured $3.4 million in a medical malpractice case where the plaintiff’s fetus sustained birth injuries after the defendants failed to deliver a necessary cesarean section.
Physicians Disregard High-Risk Factor for Birth Injury of Patient and Infant
The plaintiff’s physicians were aware that her baby was potentially large for gestational age (LGA), thus macrocosmic. However, the defendants inadequately measured the size of the baby and decided to not deliver the baby via cesarean section.
During the vaginal delivery, the infant’s body became stuck. It took seven minutes to deliver the baby, who then needed resuscitation. As a result, the infant sustained neurological injuries and an injury to the brachial plexus.
When the plaintiff delivered the baby vaginally, she sustained a third-degree perineal laceration, a sulcus tear along the left posterior vagina with perirectal fat herniating into the tear, and damage to sphincter.
