Brooklyn Man Dies After His Physicians Fail to Provide Proper Treatment

A 46-year-old husband and father of four was undergoing treatment to prevent blood clots due to his past medical history. His medical treatment included taking blood-thinning medications, however, a side effect of his medication was spontaneous gastrointestinal bleeding, which rendered him hospitalized. Shortly after being admitted to the hospital, he underwent successful surgery to stop the bleeding. The patient’s spouse remained concerned about her husband’s health, however, and urged his physicians to restart his blood thinner and insert an IVC filter to prevent future blood clots.

Despite the concerns of the patient’s spouse, the physicians caring for her husband did not restore his blood-thinning medications in a timely manner, which caused him to develop a new deep vein thrombosis in his leg during this hospitalization. The physicians also refused to place an IVC filter once he was diagnosed with the new blood clot, and further ignored the condition of his leg swelling and shortness of breath. Instead, the patient was discharged and collapsed just outside of the hospital doors. Emergency personnel witnessed this arrest and transported him into the Emergency Department.  All attempts to resuscitate him were unsuccessful, and an autopsy confirmed that his death was caused by a pulmonary embolism.

SPBMCC attorney, Elizabeth Montesano, litigated this case in the Brooklyn Court. A private mediation was held prior to trial, where a settlement was reached in compensation for the decedent’s pain and suffering and his wrongful death in the sum of $3,150,000.
