Firefighter Falls from Ladder Due to Fire Venting Through AC Sleeve

On January 10, 2018, a firefighter was thrown off of a ladder that he was standing on while battling an apartment fire. He proceeded to fall from the second story of the building as a result of fire venting through an air conditioning sleeve. As a result of his fall, the firefighter sustained an injury that required surgical intervention. Since this tragic incident, he has not been able to return to full duty status with the New York City Fire Department.

 

With the counsel of Partner Glenn W. Nick, the plaintiff filed a lawsuit containing a claim pursuant to New York State General Municipal Law § 205-a, which affords protections to firefighters injured in the line of duty as a result of certain building code violations.

 

The plaintiff claimed that the subject fire was the result of the apartment building owner failing to provide adequate heat on a cold winter day, which forced a tenant to use a dangerous space heater in her apartment that caught fire. This was confirmed both by the apartment tenant and New York City Housing Preservation and Development records that documented complaints of insufficient heat in the building in the days leading up to the fire. The plaintiff asserted that this was in violation of various building codes that require residential buildings to be heated to a certain temperature.

After completing discovery, the plaintiff placed this case on the Court’s trial calendar. Following this decision, the defendant building owner made a motion to dismiss the case. While the motion was pending, the parties were able to settle this case at private mediation for $800,000 on June 2, 2021.
