On April 19, 2022 in Westchester Supreme Court, SPBMCC Partner Mark Apostolos obtained a $1 million settlement for the family of a man who died while working on a construction site. 

 

Construction Worker Succumbs to Injuries After Suffering Workplace Accident

 

The plaintiff was working on a construction site on October 4, 2018 when he was fatally injured. He was standing on a wooden platform on top of a forklift attempting to install a window on the second story of a house when he fell. He was not provided a scaffold or any safety device to prevent him from falling. The construction worker was taken to the hospital after suffering several injuries including fractures of the spine and paraplegia before eventually passing away on October 16, 2018. 

 

The plaintiff was injured as a result of a dangerous work environment in which the defendant in the matter was acting in violation of New York State’s Labor Law. The defendant violated the labor law by failing to provide the construction worker with a scaffold or any safety device.

 

Partner Mark Apostolos Obtains $1 Million Settlement for Plaintiff’s Family 

 

The defense argued that they could not be held liable under the Labor Law because the plaintiff caused his own fatal accident. However, Firm Partner Mark Apostolos–who legally represented the victim’s family in the matter–argued that the defendant was indeed liable because they acted in violation of New York State’s Labor Law, as the safety of the construction site was not properly upheld. Apostolos was able to successfully prove that the accident was caused by the defendant’s violation of the Labor Law and that the plaintiff suffered significant pain before succumbing to his injuries. The case was settled for the policy limit of $1 million.
