The plaintiff in the case was a 35-year-old woman who was a tenant in a building when she was assaulted and raped by a gun-bearing assailant who gained access to her apartment building through a door. The plaintiff was later diagnosed with post-traumatic stress disorder as a result of the incident.

The plaintiff claimed that the door through which the assailant entered the apartment building was negligently maintained. The defendant claimed that the assailant piggy-backed into the building when the plaintiff opened the entrance door. The security company argued that they provided security as per the contract with the owner, and did not have a duty to the plaintiff.
While the case was on the trial calendar with a summary judgment motion pending, the prosecution and defense resolved the matter for $700,000 at mediation.
