SPBMCC Firm Partner Liza Milgrim Obtains Settlement for Victim in Labor Law Accident

On November 10, 2021, SPBMCC partner Liza Milgrim obtained a $700,000 settlement on behalf of a steel fabricator that was injured on the job.
Welder Suffers Third-Degree Burns From Scorched Steel
The plaintiff, a 38-year old welder, was assisting in the installation of a steel staircase. When the plaintiff was welding while on the scaffold, the scaffold shifted. This caused the plaintiff to unintentionally burn a portion of the steel. The portion of burning steel fell onto the plaintiff’s leg, which burned through his pants and down into his boot. The burning steel caused third-degree burns on his foot and ankle.
The plaintiff was admitted to the hospital for 21 days and was required to undergo surgical procedures. He was unable to return to work for a protracted length of time.
Partner Liza Milgrim Obtains $700,000 Settlement for Plaintiff’s Medical Expenses and Pain and Suffering
Following the completion of the discovery process, the defendants moved for summary judgment based on sole proximate cause, while the plaintiff moved for summary judgment based on Labor Law 240(1) and 241. (6). Firm Partner Marie Ng was the responsible attorney in the earlier stages of the case, and then Partner Liza Milgrim ultimately settled the case.
SPBMCC legal counsel asserted that the defendant’s claims were unjustified. While both motions were pending, the parties participated in non-binding mediation, which led to a $700,000 settlement that will cover the plaintiff’s medical expenditures, pain and suffering, and other losses of income.
