Trip and fall resulting in fractured hip and wrist settles for $750,000

September 18, 2018 in ,

Personal injury attorney, Steve Fils-Aime, Esq., recently settled a lawsuit arising out of a trip and fall incident.

The client, an elderly grandmother, had traveled to the defendant’s premises, a supermarket, to go grocery shopping with her husband. While entering the supermarket, the client tripped and fell on a broken portion of the curb attached to the sidewalk of the premises. As a result of her trip and fall, the client sustained a fractured hip and wrist.

Prior to the incident, the client had maintained an active lifestyle and was a significant part of her family’s lives despite suffering a number of health conditions. Following the incident, her health rapidly deteriorated to the point that she became wheelchair bound. Further complicating the matter, the client was rendered unable to speak due to the worsening of her symptoms from a stroke which had occurred years prior.

During the course of discovery, the defendant filed for bankruptcy, resulting in an automatic stay of all legal proceedings against them. After negotiating the lifting of the bankruptcy stay, it was revealed that the defendant had previously contracted for repairs to the sidewalk where the incident occurred.

Thereafter, a recovery was obtained on behalf of the client in the sum of $750,000.00 at mediation.
