Montesano Negotiates $1,350,000 Settlement For Plaintiff in CT Scan Misdiagnosis Case

In a King’s County court on October 26, 2021, firm Partner Elizabeth Montesano successfully obtained a $1,350,000 settlement in a cancer misdiagnosis case.
Radiologist Misreads CT Scan of Patient Suffering From Leiomyosarcoma
SPBMCC’s Elizabeth Montesano represented the daughter of a 59-year-old Brooklyn woman who died from an advanced and terminal stage of cancer known as leiomyosarcoma, a rare type of cancer that grows in the muscles of the body. In this particular case, the patient’s cancer was visible on a CT scan of the abdomen and pelvis performed at a local radiology facility in March 2013. However, the defendant radiologist misread the scan’s results.
When her symptoms of abdominal pain worsened nine months after the initial CT scan, the patient’s same radiologist read a second CT scan of the abdomen and pelvis. This time, the radiologist identified a large mass in the pelvic region. When he looked back at her prior study, he saw that it was there and he had never reported it.
As a result of this 9-month delay in the patient’s cancer diagnosis, the mass had now tripled in size and spread throughout her pelvic region. Despite chemotherapy, radiation therapy, and multiple surgical procedures, the patient’s cancer continued to spread to her right lung, liver, spleen, and kidney. After two years of ongoing and continuous treatment, our client’s mother eventually succumbed to her cancer.

The decedent was an active and otherwise healthy woman working as a home attendant. She was divorced and had one daughter. Her daughter turned to the attorneys at SPBMCC to seek compensation for her mother’s pain and suffering, as well as her untimely death.
While awaiting a trial date to be issued by the Court, Elizabeth Montesano, Esq. successfully negotiated a settlement in the sum of $1,350,000 for the decedent’s pain, suffering and wrongful death.
