SPBMCC Member John F. Nash Obtains $1.75 in Labor Law Case
December 18, 2023 in Personal Injury, Worker's Compensation
On March 10, 2022, SPBMCC Partner John Nash successfully secured a $1.75 million settlement for a 63-year-old man who suffered a right knee fracture at his workplace.
63-Year-Old Man Unable to Work After Severe Injuries
In July 2020, a 63-year-old non-union laborer for a Long Island polymer company was part of a crew resurfacing the insides of a wastewater holding tank in Great Neck when a rope hoisting a HEPA filtration component from the ground level to the top of the waste tank snapped. A co-employee who was hoisting the HEPA component by way of a rope was caused to fall backward into our client, knocking him down and falling the client’s right leg. This severely injured him when the rope snapped.
The plaintiff was taken by company van to North Shore University Hospital in Manhasset, where his fractures were diagnosed. After conservative treatment failed, he was operated on at South Nassau Communities Hospital and underwent a total right knee replacement.
The plaintiff also aggravated a long-standing, painful spinal issue that was previously treated by medicine. After the incident, the plaintiff underwent the installation of a pain pump implant to control increasing pain but was unable to return to work.
Firm Member John F. Nash Represented the Plaintiff
Following the serious and life-changing injuries suffered by the plaintiff, he sought counsel through SPBMCC. Firm member John F. Nash obtained a $1.75 million settlement in National Arbitration and Mediation/Robert Adams. This will compensate for lost salary and benefits of approximately $500,000 and repayment of worker’s compensation of $133,000.
