On November 3, 2021 in New York State Supreme Court, Kings County, Sullivan Papain Block McManus Coffinas & Cannavo P.C. Partner Glenn W. Nick recovered a $1.6 million settlement on behalf of a New York City firefighter and his wife. 

 

Firefighter Uses Scuttle Ladder to Access Building Fire

 

On March 6, 2018, our client responded to a building fire in Brooklyn. To gain access to the building’s roof, he ascended a scuttle ladder. He then opened a heavy roof hatch, which suddenly crashed back down, falling onto his head.

 

As a result of this incident, our client sustained serious personal injuries, including spinal herniations and a severe concussion. After undergoing conservative treatment in the form of physical therapy and epidural injections, a cervical fusion utilizing hardware was required. The procedure prematurely ended our client’s career with the New York City Fire Department.

We claimed that the roof hatch was negligently maintained by the owner of the building, specifically that it was missing hardware components. The missing components would have controlled the opening and closing of the hatch. This would have allowed the roof hatch to lock in the “open” position. Wew claimed that the hatch was in violation of both the New York City Administrative Code, The Fire Code for the City of New York, and the New York State Multiple Dwelling Law, which all require that buildings be kept in good and safe repair. 

 

After placing the case on the trial calendar in New York State Supreme Court, Kings County, the parties reached a mediated settlement on November 3, 2021 totaling $1,600,000 for the client’s pain and suffering.
